DealPulse Terms of Service

Welcome to Dealpulse, a service provided by Atlas Peak Group, LLC ("Company", "We"). These Terms of Service ("Terms") govern your use of our services. By accessing or using our website located at getdealpulse.com, you agree to be bound by these Terms. If you do not agree with these Terms, you may not access or use our services.
1. General Provisions
- These Terms constitute a legally binding agreement between you ("User") and Atlas Peak Group, LLC.
- Your access and use of the Services constitute your agreement to be bound by these Terms in compliance with the laws of Delaware.
- The Company reserves the right to change, remove, or add to the content of the Terms at its sole discretion. All new or revised provisions of the Terms take effect immediately upon posting on the Website.
- Significant changes to these Terms will be notified to you by posting a notification on the Website or sending you an email.
- You can review the most current version of the Terms on the Website. Your continued use of the Services after changes to the Terms signifies your acceptance of the new and/or revised Terms.
- If you do not agree with the new and/or revised provisions of the Terms, you cannot use the Services.
2. Key Terms
- "Leads" refers to sellers of real estate published on the Website.
- "My Leads" refers to the Leads purchased by You through the Website.
- "Credit/Debit Card" is a Credit or Debit Card linked to a User’s Profile.
3. Services
- The Company provides the following Services:
- Purchasing of Leads for the purchase of real estate;
- The Website is a Lead portal for our Users where Users can view purchased Leads and enter payment information such as Credit/Debit card details for purchasing leads.
- The Company may refuse to process any Lead purchase that violates these Terms or Applicable Law at its discretion without explanation.
- You are solely responsible for keeping information related to Your Credit/Debit Card secure.
- We declare that we do not use Your Credit/Debit Card details outside of the Services provided through the Website. All transactions with Your Credit/Debit Card are voluntary payments for the Services we provide to You.
- If Your Credit/Debit Card payment is declined, we will continue attempting to charge Your Credit/Debit Card until a successful payment goes through or You close your account by contacting support@getdealpulse.com.
- If You add multiple Credit/Debit Cards to the Website, all cards can be charged for the Services we provide regardless of the 'Default' card. You can remove a Credit/Debit Card by contacting support@getdealpulse.com.
4. User Account
- To use the Services, You must be at least 18 years old and have the capacity to enter into a legally binding agreement.
- You must create a User Account on the Website to access the Services. You must not create a User Account on behalf of another individual or entity unless You are legally authorized to do so.
- By opening a User Account, You agree to:
- Provide accurate and up-to-date information to the Company;
- Not share Your User Account and/or password with third parties;
- Not create more than one User Account;
- Update Your User Account information when necessary.
- The Company may automate the account creation process using the information provided on the Website. You must change Your password the first time You access the account.
- You must keep Your Account details secure and notify the Company immediately of any breach of security or unauthorized use of Your User Account.
- The Company reserves the right to terminate access to Your User Account without notice or reason for any violation of these Terms or Applicable Law.
- You may close Your User Account at any time by contacting support@getdealpulse.com.
5. Purchasing Of Leads
- Leads can only be purchased automatically using the bids per territory You provided during the onboarding call or that You added in the 'My Territories' section of the Website.
- The Lead purchasing process is carried out in the following order when the user schedules an onboarding call:
- The User enters Credit/Debit Card details and clicks “SAVE”;
- The User optionally provides a monthly budget for purchasing Leads on the onboarding call;
- The User provides bids per territory for purchasing Leads on the onboarding call;
- The Company enters this information into the system, and charges the User two times the highest bid in a single territory.
- The Lead purchasing process is carried out in the following order when the user onboards Himself/Herself:
- The User adds territories and sets bid prices using the '+ Add More Territories' feature on the Website;
- The User enters Credit/Debit Card details and clicks “SAVE”;
- The User optionally sets a monthly budget;
- The User adds funds to His/Her account for two times the highest bid in a single territory.
- Account Balance and Payments can be viewed in the User Account.
- All payments are upfront and final. Refunds are only allowed through the refund policy specified on the Website.
6. User's Account
- User can always review data about itself in Settings. You can find more information about the policy of using storage of data about the User on the Privacy Policy webpage.
- All information about the User is confidential and is not transferred to third parties.
- You may modify Account information by contacting support@getdealpulse.com.
7. Unauthorized Transactions
You agree to safeguard Your Credit/Debit Card against unauthorized use by taking all reasonable precautions. If You believe that someone has made an unauthorized transaction with Your Credit/Debit Card (or may attempt to use Your Credit/Debit Card without permission) or You believe an error has occurred with Your Credit/Debit Card, You agree to notify us immediately at support@getdealpulse.com and in no event later than seven (7) days of the date of the transaction at issue.
8. User Conduct
- During using the Website, You shall:
- not violate or assist any third party in violating these Terms and/or Applicable Law, which may include but is not limited to international laws, national laws, statutes, regulations, etc.;
- not provide false, inaccurate, incomplete, and misleading information to the Company;
- not violate intellectual property rights (trademark, copyright, patent, and other intellectual property rights) of the Company;
- not use the Website in any way that can damage, disable or overburden the Website, which may include but is not limited to uploading or in any other way, while using the Website, sending viruses, Trojan horses, spyware, adware or any other malicious code; performing DDoS attacks, interfering with or disrupting any network, equipment, or server connected to or used to provide services on the Website;
- not impersonate or misrepresent your affiliation with another User, person, or entity, nor make other fraudulent, false, deceptive, or misleading representations;
- keep means of access and the wallet, connected to Website separate and secure;
- not give any third person the wallet, connected to Website, access to your wallet or means of access to them.
- not violate these Terms and the Applicable Law in any other way.
- You are solely liable for all liabilities arising from your use of the Website.
9. Intellectual Property Rights
The Website and its entire contents, features, and Services are owned by the Company and protected by copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
You may use the Website for your use only, subject to certain restrictions outlined in these Terms.
10. Disclaimers and Limitations of Liability
- The Company does not guarantee that Services are error-free, reliable, or will operate without interruption. The Website is provided to You on the “as-is” basis.
- If You are not satisfied with the conditions and/or quality of the Services, You must stop using the Services. Your use of the Services shall mean that You have no claims regarding conditions and/or quality of the Services against the Company.
- In no event shall the Company, its officers, directors, employees, agents, and all third-party service providers, be liable to You or any other person or entity for any direct, indirect, incidental, special, punitive, or consequential damages whatsoever.
- Except as expressly set forth herein, the Company makes no express, implied, or statutory representations, warranties, or guarantees in connection with the Website and Services.

12. Refund Policy
All Dealpulse users have the right to request refunds as described in Company refund policy: https://getdealpulse.com/refund-policy/
All Dealpulse users agree not to lie or subvert the refund policy by telling leads to feed Dealpulse false information about their situation.
In the event Dealpulse discovers a user has lied or subverted the refund policy, Dealpulse retains the right to cancel the account, decline any pending refunds, and withhold the account balance.
13. Claims, Chargebacks, and Disputes
- All Dealpulse users agree to waive all disputes and not to open claims, chargebacks or disputes against Dealpulse for whatever reason.
- To dispute any charge related to the Services, all Dealpulse users agree to contact Dealpulse in writing at support@getdealpulse.com within 30 days of receiving the charge being disputed.
- In the event Dealpulse receives a chargeback from a credit card company or bank on your behalf, Dealpulse will immediately suspend the account pending the outcome of the dispute.
- In the event Dealpulse uses a third-party collection service or attorney to collect money owed to us by you, Dealpulse may assess you a 40% processing fee or the maximum applicable by law whichever is lower, and you will be charged all reasonable costs and fees associated with such a collection.
14. Applicable Law and Dispute Resolution
- If any relations between You and the Company are not regulated by these Terms, they shall be regulated by the laws of Delaware.
- You and the Company shall endeavor to resolve through negotiations all disagreements that may arise between You and the Company during the validity term hereof.
- If the parties fail to reach an agreement on the dispute within 30 calendar days from the start of negotiations, the dispute shall be submitted to the competent court under the Applicable Law.
15. Final Provisions
- These Terms shall remain in force until terminated by the Company. The Company may terminate these Terms at any time at its own discretion without explaining the reasons for this decision.
- These Terms of Service, Privacy Policy, Refund Policy, and any other notices and disclaimers on https://getdealpulse.com/ constitute the entire agreement between You and the Company regarding Your use of the Services.
